    You realize you have done a good job when they begin to make T-shirts in America with your bike picture on them.

    If its your photo and they are using it for a profit, they are definitely in the wrong and absolutely it's your copyright.

    I'd be sending a formal letter informing them of the payment they are due to you for the use of your image..

    I would say (glancing through Chevrils link) that although you have posted that photo somewhere without a copywrite notice. Since 1989 you will still own the copywrite to it.
    Unsure whether that applies to the T shirt company though, if its outside the USA.

    tricky area. Assuming a) the manufacturer does not admit the copyright breach and b) you have the will to contest, you have to look in forensic detail at the original and the copy. So you could work out the repro scale and measure stuff like highlight refelctions (there's a very noticeable one on header #1in the original for example) and also tread patterns, tyre scuffs, chicken strips etc etc....... that's just the beginning..... and you have to ask yourself how much return you are likely to get for all the effort should you be successful.

    ..so we can assume you work for free ? the cunts are the ones who first steal, then commercialize other peoples creative output (IMHO).

    however.

    i just overlayed the two pics for you to see : they stretched your shot slightly, probably because they are fully aware of their shitty deed.

    it is obiously your photo they used.
