just been side swipped by a f**king car driver this afternoon (6:17pm)lights went green an off i set from light's i got 30 yards an i see a car to my right comin right at me didnt have time to brake so pinned the throttle an swerve to the left, he twated the back endoff ma bike an sent me and our lass spinning dwn the road, the car then disapears off round the corner as we were sliddinmg dwn the road tried to legg it. he an his mrs were dragged back by witness'es, the caris hers but they say he driving but i got two witnesses say that it was her driving so they hidding something, so me an our lass fine now we been to hosp but the bike is bit of a right off, front fairing an indicator's, tank. right engine caseing handlebars mirror brake lever, rear right fairing pannel an best of all the swinging arm looks to be bent as the metal is stressed at the excentric's an all bike gear trashed, gonna tell insurance company tomorow as they shut at the mo, bolocks ma pride an joy ruined by a car driver jumping a red
police been involved so got statements an stuff.
so any advice would be great, maybe u had similar thing an can help

Keep a diary of all your aches and pains, photos too. If driver was uninsured and you aren't fully comp then you may have to sue him/her to get your money. There are plenty of no win no fee lawyers in MCN.
Apart from that take it easy. and keep a look out for dealers doing deals on Rexes.

You can get it sorted at least you two are ok, that's what really matters. Good luck with the claim, maybe she had been drinking so they swapped before returning?

sorry to hear ,sounds like your lucky to not be injured worse.
these people should be jailed .
get lots of photos ,go back in daylight make sketches,you cant have to many witnesses either.
make sure the cops check them and there car over,dont leave anything to chance.
i was a witness to a bike accident in court last week.
the geezer had deliberatley side swiped a bike 200m in front of me.
it was the evidence of a buisness man that nailed him[the other witneses where bikers] yet he nearley didnt stop.the bloke stuck the nut on me when i stopped him driving off ,as i didnt retaliate[difficult belive me] probaly going down.
any way hope you get it sorted before the summer........... :banned: them

I know exactly how you feel,am going thru it myself,b'stard just pulled right out in front of me.4 months later and I'm still off work,like the guys say right everything down you remember about it even the stupid little things.Make a note of any expenses you run up as well and then be prepared for a long wait.
Most of all be patient and thankful that you were'nt hurt really badly,dont dwell on what could've happened but what actually did.
Good luck and dont let the b'stards get you down.

Can't help on the courtesy thing - speak to your insurance company and remember they don't have to lend you something like the Rex anyway, just transport so you might end up with a Dneiper. :(
Photos and more photos: remember also that bruises will take a day or two to get really impressive proportions.
Make a note of replacement costs for all your kit even if it's only scuffed up.
Get lots of photos of the scene too: skidmarks, scratches and gouges.

You'd have to phone your insurance company to see if they do courtesy bikes, some do, so dont.
Please invite the car drivers to the Ace in March, we will make them most welcome :eyebrow: .

Srednas- that sort of thing ruins your day!
Sounds like you did good by accelerating, probably saved you from much worse.
Did the police come to the scene?
A mate of mine always says a good accident is one you can walk away from!
Those witnesses could be worth their weight in gold.
Like everyone else has said- glad to know you and pillion weren't too badly hurt, and all the best with the claim.

I was damm lucky the other day, same thing, woman in bloody great 4WD Toyota Landcruiser came straight through a red light and by sheer "dumb luck" I managed to avoid the mad bitch.

Good luck there Srednas. Glad you're both ok, like everyone says that's the important thing, but it hurts like fook that your bikes smashed up don't it ? Took me a year to get a payout for my last accident, no injuries, no witnesses, my word against his. Didn't use a lawyer, just told the truth. I was lucky though, the other bloke's insurance company sent a 12 year old filing clerk to court to fight their case. He was nearly crying by the time I'd finished with him. Ha !
I would suggest you find a good lawyer asap. NOT one of the no win no fee vultures either, a proper lawyer. If the police are involved, there are witnesses, and it's as clear cut as you've described, you won't have to worry about paying their fees, and you'll end up getting more. At the end of the day, there was an accident, you were both there, and only one of you did something wrong. And the winner is.....
Take as much time off as you can afford, do everything everyone else has said (apart from Gremlin) and don't ever give up.

sori to hear it took 12 months hope mine dnt take that long. layer sounds gud but cant afford one at the mo still recovering from x-mas, im just in the middle of trying to find my documents but kinda struggling does anyone knw if i can use a tempory cover note 4 the police provider as i have one of them an cant find the offical certifiacte.

if your cover note is current (in date) then it is ok to use that one, but you may need to provide a complete one after the cover note runs out. If you can't find your cert, your insurance company will send a duplicate but may charge, if they are on the internet you can usually order a duplicate for free.

That kinda contradicts itself Redrex seeing as how I suggested Srednas follows everybody elses advice. :dunno:.
Thankfully I've never been in this situation before so have no experience of how to deal with it. I had a similar near miss last year if you recall the thread Gremlins' Wheelie School (http://www.zrxoc.com/board/showthread.php?t=587&highlight=gremlins+wheelie+school). I know I made light of it at the time but that was out of relief for what might have happened. I nearly finished up under the wheels of a petrol tanker only last week for exactly the same reason. :eek:
Perhaps some of our traffic lights need a longer delay on them to avoid these tw@ts making such dangerous last minute manouvers.
Perhaps also, I'd better remember to check to the right at every set of lights and not just assume the traffic has stopped just because it's supposed to. :knock:

If the prats who put up speed cameras were really interested in safety rather than stealth tax, cameras on traffic lights would be a great idea.
On one junction in Belfast there's a camera just to catch people going through reds. Great idea.

Again check with your insurance, you may have cover that will pay for a lawyer.

Hopefully you have lots of witnesses. I took two at my accident last April and they both gave false addresses (they must have been together). Wish they'd just said that they didn't want to get involved and I could have picked someone else. I'm going to court and I reckon I'll get proper fu@ked.........

Bad luck mate, but at least you are ok.
There are specialist bike lawyers who advertise in the bike mags, might be worth giving them a ring for advice.
I always tend to treat traffic lights as a give way, a quick look before i pull away.

Sorry to hear about your accident,at least you walked away maybe you will be able to buy the bike back of the insurance company and sort it out with a few trcik bits,all the best.

cheers for the support and advice guy's as usual u've been great i now got to watch it get taken away form wrk as the insurance has arranged 4 it to be picked up tromorow......gutted.... im affraid that i'll never see it again as they might right it off, but gotta do it to get sorted, just lashed out £115 for a new rear pirrelli diablo corsa tire on the rex a week ago so even more annoyed as i now had to tax the R1 and0 book it in for tomorow for the same thing but as its 10mm wider its £11 more could of saved the tire for the R1.
i been back to the crash site an watched the traffic lights sequence from all angles an he deffinatly ran a red or jumped it 5 seconds early so hopefully should be pretty sound an straight forward.gonna get some pics of the damage tonight at wrk for all to see,
anymore suggestions more than welcome

Did you pay for legal cover with your insurance premium? If you did, they should get it all sorted for you otherwise it's down to you to do it .
If the other party claimed responsibility you can reclaim the cost of hiring another bike but it may be more difficult of the bike wasn't your only transport.
